{"id":105,"date":"2024-02-23T10:25:29","date_gmt":"2024-02-23T14:25:29","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/antitrustlaw\/?p=105"},"modified":"2024-03-05T12:30:24","modified_gmt":"2024-03-05T16:30:24","slug":"federal-and-state-antitrust-enforcers-reiterate-focus-on-healthcare","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/antitrustlaw\/2024\/02\/23\/federal-and-state-antitrust-enforcers-reiterate-focus-on-healthcare\/","title":{"rendered":"Federal and State Antitrust Enforcers Reiterate Focus on Healthcare"},"content":{"rendered":"<p>Federal and state antitrust enforcers are keenly focused on potential anticompetitive conduct in the healthcare space.<\/p>\n<p>Federal Trade Commission Chair Lina Kahn recently noted that \u201cthe FTC is squarely focused on tackling illegal business practices that deprive Americans of access to affordable and innovative healthcare\u201d in a speech to the American Medical Association\u2019s national advocacy conference. \u00a0According to Chair Kahn, medical professional consistently express frustration to the FTC \u201cabout how the business of healthcare today forces many [medical providers] to subordinate [their] own medical judgment to corporate decision-makers at the expense of patient health.\u201d In response to those complaints, Chair Khan highlighted a few recent enforcement efforts, including scrutiny of <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/02\/ftc-hhs-seek-public-comment-generic-drug-shortages-competition-amongst-powerful-middlemen\">group purchasing organizations<\/a>, drug wholesalers, and <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2022\/06\/ftc-launches-inquiry-prescription-drug-middlemen-industry\">pharmacy benefit managers<\/a>; tackling unlawful consolidation in healthcare markets and <a href=\"https:\/\/www.duanemorris.com\/alerts\/ftc_targets_private_equity_challenge_anesthesiology_rollups_0923.html\">roll-ups<\/a> of healthcare providers. She also touted the FTC\u2019s work protecting healthcare workers, tackling unlawful practices by pharmaceutical companies, including suits to block two major pharmaceutical mergers, and protecting patient privacy and data.<\/p>\n<p><!--more--><\/p>\n<p>At the state level, California is proposing new legislation, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB3129\">A.B. 3129<\/a>, that would require private equity or hedge fund owners to provide written notice to the state\u2019s attorney general 90 days before an acquisition or transaction involving change of control of a health care facility, provider group or both. The proposed bill would authorize California\u2019s Attorney General to grant, deny or impose conditions on such a transaction. This move comes in the wake of increased consolidation in the healthcare space in an effort to integrate care and control costs.
