McDonald&#8217;s USA, LLC<\/em>.\u00a0 The circuit court <a href=\"https:\/\/blogs.duanemorris.com\/classactiondefense\/2023\/08\/28\/seventh-circuit-breathes-new-life-into-ex-workers-antitrust-wage-suppression-class-action-battle-with-mcdonalds\/\">held<\/a> that plaintiffs sufficiently alleged that a no-hire provision in McDonald&#8217;s franchise agreements was presumptively illegal under federal antitrust law without consideration of the provision&#8217;s procompetitive impact on other markets, including the sale of McDonald&#8217;s food and beverages.<\/p>\n<p>Whether certain employment restraints, such as no-poach and no-hire provisions, violate the federal antitrust laws has been an issue of much <a href=\"https:\/\/www.duanemorris.com\/alerts\/dojs_original_no_poach_prosecution_dismissed_whats_next_antitrust_enforcement_1123.html\">debate<\/a> over the last several years. DOJ dropped its last criminal no-poach case in November of last year after several high-profile failures to convince judges and juries to treat such provisions as <em>per se<\/em> violations of the Sherman Act.\u00a0<em>Deslandes v.
