That is, cases brought by two herring fishing companies are before the Supreme Court that could have wide-reaching influence. The cases challenge actions taken by the National Marine Fisheries Service and longstanding <em>Chevron <\/em>deference. Under <em>Chevron<\/em>, courts afford deference to reasonable agency interpretations of ambiguous laws. At oral argument last week, the Court <a href=\"https:\/\/www.duanemorris.com\/alerts\/us_supreme_court_signals_it_may_jettison_chevron_doctrine_0124.html\">signaled a willingness to overturn <em>Chevron <\/em>deference<\/a>. This is notable for the Artificial Intelligence space that lacks explicit legislation from Congress.\u00a0 Indeed, the <a href=\"https:\/\/www.duanemorris.com\/alerts\/white_house_artificial_intelligence_executive_order_impacts_myriad_sectors_law_1123.html\">Executive Order on Artificial Intelligence<\/a> last year is largely directed at Federal Agencies, instructing the agencies to take action. In the absence of <em>Chevron <\/em>deference, actions taken by agencies pursuant to that order could be more susceptible to legal challenge.\u00a0 Justice Kagan even <a href=\"https:\/\/www.scotusblog.com\/2024\/01\/supreme-court-likely-to-discard-chevron\/\">called out AI in oral argument<\/a> as an area that could see effects from the Court&#8217;s ruling.\u00a0The Supreme Court is expected to rule by the end of June. <strong><\/p>\n<p><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Herring fishing \u2013 of all things \u2013 could have a big impact on AI regulation in 2024.
