New Jersey Medicinal Marijuana Program Set For Expansion

Just days after the NJ Senate and Assembly close in on expansion of medical use Cannabis, the New Jersey Department of Health (“Department”) published notice of a Request of Applications (“RFA”) for an additional 108 alternative treatment center (“ATC”) permits which authorize holders to cultivate, manufacture, and/or dispense medicinal marijuana.   • ELIGIBILITY: Both non-profit and for-profit enterprises may apply. Each applicant may submit up to three applications but may only submit one application for a cultivation endorsement and manufacturing endorsement, respectively.
  • ENDORSEMENTS: Applicants are eligible for an ATC permit with one or more separate endorsements for cultivating, manufacturing or dispensing medicinal marijuana.   A separate application must be submitted for each desired endorsement. The Department will award no more than three total endorsements to each applicant and no entity may hold more than 1 cultivation endorsement, 1 manufacturing endorsement, and 3 dispensary endorsements. The following endorsements will be available in each region of the state:
    • Northern Region
      • Cultivation: 8
      • Manufacturing: 10
      • Dispensing: 20
    • Central Region
      • Cultivation: 8
      • Manufacturing: 10
      • Dispensing: 20
    • Southern Region
      • Cultivation: 8
      • Manufacturing: 10
      • Dispensing: 14
  • IMPACT ON CURRENT ATC HOLDERS/AWARDEES. Current fully integrated ATC permit holders and awardees are considered to hold 1 cultivation endorsement, 1 manufacturing endorsement, 1 dispensary endorsement, and 1 additional dispensary endorsement for every satellite location that been proposed to the Department, provided that the Department will allow the rescission of a pending proposal.
  • FEES.
    • Non-Refundable Application Fee: $2,000
    • Initial Permit Fee: $18,000 (will be refunded to unsuccessful applicants)
  • IMPORTANT DATES.
    • July 1, 2019: Start of Application Period
    • July 5, 2019: Deadline for Submission of Non-Technical Questions
    • July 16, 2019: Pre-Application Webinar
    • August 15, 2019: Application Deadline

The timeline for awarding permits under this RFA will be dictated by the number of applicants. The Department has discretion to stagger awards by endorsement type with cultivators being announced first, followed by manufacturers second and dispensaries third.
