{"id":1398,"date":"2023-05-03T14:34:59","date_gmt":"2023-05-03T18:34:59","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/cannabis\/?p=1398"},"modified":"2023-05-30T15:38:47","modified_gmt":"2023-05-30T19:38:47","slug":"cannabis-highlights-in-the-nbas-new-collective-bargaining-agreement","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/cannabis\/2023\/05\/03\/cannabis-highlights-in-the-nbas-new-collective-bargaining-agreement\/","title":{"rendered":"Cannabis Highlights in the NBA\u2019s New Collective Bargaining Agreement"},"content":{"rendered":"<p>On April 26, 2023, the National Basketball Association (NBA) <a href=\"https:\/\/www.nba.com\/news\/nba-nbpa-cba-ratified\">announced<\/a> the ratification of its new, seven-year Collective Bargaining Agreement (CBA) with the National Basketball Players Association (NBPA).\u00a0 The CBA will take effect on July 1, 2023, and will run through the 2029-30 season.\u00a0 The CBA provides, among other things, certain key changes to cannabis-related matters, particularly in connection with the NBA\u2019s Anti-Drug Program and NBA players\u2019 business opportunities.<\/p>\n<p><u>Anti-Drug Program<\/u><\/p>\n<p>According to a <a href=\"https:\/\/assets.law360news.com\/1602000\/1602239\/cba%20media%20summary%202023%20as%20of%204-27-23.pdf\">summary of the agreement<\/a> as reported by Law360, the NBA decided to remove cannabis from its Prohibited Substances List.\u00a0 However, NBA players are still subject to random drug tests.\u00a0 The NBA has authority to conduct up to 1,925 random urine tests each season.\u00a0 In addition, teams may refer players to a treatment program if they suspect them of (1) being under the influence of cannabis while participating in league activities, or (2) experiencing a dependency on cannabis.<\/p>\n<p>Furthermore, the NBA may still discipline players for violating the law or for being under the influence during league or team activities. \u00a0Players who neglect or fail to comply with the Anti-Drug Program will be banned from league activity.\u00a0 Nevertheless, players may now apply for reinstatement of eligibility after one year, as opposed to the two-year rule enforced since 1983.<\/p>\n<p><u>Business Opportunities<\/u><\/p>\n<p>NBA players are also now permitted to: (1) invest in companies that make CBD-infused products, and (2) hold a passive, non-controlling interest in companies that make products with more substantial concentrations of THC.\u00a0 Although players may now promote companies that make CBD-infused products, the NBA continues to prohibit players from promoting cannabis companies and marijuana products.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On April 26, 2023, the National Basketball Association (NBA) announced the ratification of its new, seven-year Collective Bargaining Agreement (CBA) with the National Basketball Players Association (NBPA).\u00a0 The CBA will take effect on July 1, 2023, and will run through the 2029-30 season.\u00a0 The CBA provides, among other things, certain key changes to cannabis-related matters, &hellip;
