Riley<\/a> <\/strong><\/p>\n<p><strong><em>Duane Morris Takeaway:<\/em><\/strong><em> As authors and editors of our firm\u2019s our Class Action Review, we identified ten (10) key trends in class action litigation over the past year. Trend # 1 focuses on the unprecedented number of massive class action settlements reached in the last 12 months. Aside from the Big Tobacco settlements nearly two decades ago, 2022 marked the most extensive set of billion-dollar class action settlements in the history of the American court system. <\/em><\/p>\n<p><em>\u00a0<\/em>In 2022, there were 15 class actions that resolved cases for $1 billion or more in settlements.<\/p>\n<p>In the aggregate, the value of these settlements totaled $63.66 billion. The members of the billion-dollar settlement club include the following:<\/p>\n<p><a href=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/bar.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-281\" src=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/bar.png\" alt=\"\" width=\"578\" height=\"486\" srcset=\"https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/bar.png 578w, https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/bar-300x252.png 300w\" sizes=\"auto, (max-width: 578px) 100vw, 578px\" \/><\/a><\/p>\n<p>The largest 20 settlements during 2022 included the following:<\/p>\n<p><a href=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/settlement-case-names.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-280\" src=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/settlement-case-names.jpg\" alt=\"\" width=\"579\" height=\"434\" srcset=\"https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/settlement-case-names.jpg 579w, https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/settlement-case-names-300x225.jpg 300w\" sizes=\"auto, (max-width: 579px) 100vw, 579px\" \/><\/a><\/p>\n<p>Many of these settlements arose from opioid litigation against the pharmaceutical industry.<\/p>\n<p>On an aggregate basis, class actions and government enforcement lawsuits against opioid manufactures, retailers, and distributors garnered more than $50 billion in settlements.<\/p>\n<p><a href=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/top-settlement-bar-chart.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-279\" src=\"http:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/top-settlement-bar-chart.jpg\" alt=\"\" width=\"589\" height=\"442\" srcset=\"https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/top-settlement-bar-chart.jpg 589w, https:\/\/blogs.duanemorris.com\/classactiondefense\/wp-content\/uploads\/sites\/56\/2023\/01\/top-settlement-bar-chart-300x225.jpg 300w\" sizes=\"auto, (max-width: 589px) 100vw, 589px\" \/><\/a><\/p>\n<p>Much like the era of Big Tobacco settlements that transformed that industry, the opioid settlements are transforming the pharmaceutical industry and its distribution chain.<\/p>\n<p>When the final tally is completed over the next several years, the aggregate settlements may top $100 billion.<\/p>\n<p>These settlements have redistributed wealth at an unprecedented rate.<\/p>\n<p>The plaintiffs\u2019 class action bar scored rich settlements in virtually every area of class action litigation. The following provides the overall total of the top 10 most lucrative settlements in each of these areas:<\/p>\n<p><strong>$50.32 billion <\/strong>\u2013 Products liability class actions and mass tort<br \/>\n<strong>$8.596 billion <\/strong>\u2013 Consumer fraud class actions<br \/>\n<strong>$3.729 billion <\/strong>\u2013 Antitrust class actions<br \/>\n<strong>$3.254 billion <\/strong>\u2013 Securities fraud class actions<br \/>\n<strong>$1.31 billion <\/strong>\u2013 Civil Rights class actions<br \/>\n<strong>$896.7 million <\/strong>\u2013 Privacy class actions<br \/>\n<strong>$597 million <\/strong>\u2013 Employment discrimination class actions<br \/>\n<strong>$574.55 million <\/strong>\u2013 Wage &amp; hour class and collective actions<br \/>\n<strong>$404.5 million <\/strong>\u2013 Government enforcement actions<br \/>\n<strong>$399.6 million <\/strong>\u2013 ERISA class actions<br \/>\n<strong>$719.21 million <\/strong>\u2013 Data breach class actions<br \/>\n<strong>$210.11 million <\/strong>\u2013 Fair Credit Reporting Act class actions<\/p>\n<p>Suffice to say, 2022 was unlike any other year on the class action settlement front.
