Pursuant to the executive order, OSHA issued\u00a0<a title=\"Protecting Workers: Guidance on Mitigating and Preventing the Spread of COVID-19 in the Workplace\" href=\"https:\/\/www.osha.gov\/coronavirus\/safework\" target=\"_blank\" rel=\"noopener\">guidance<\/a>\u00a0on January 29, 2021 that includes extensive information for structuring and implementing an effective COVID-19 Prevention Program to protect their workforces.<\/p>\n<p>The guidance states that it is \u201cadvisory.\u201d However, failure to follow the guidance may expose employers to, among other risks, OSHA citations and substantial penalties for violating the OSHA general duties clause.
