{"id":1272,"date":"2026-06-29T07:17:10","date_gmt":"2026-06-29T11:17:10","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/?p=1272"},"modified":"2026-06-29T07:17:11","modified_gmt":"2026-06-29T11:17:11","slug":"uk-compound-penalty-of-569157-imposed-on-named-energy-company","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2026\/06\/29\/uk-compound-penalty-of-569157-imposed-on-named-energy-company\/","title":{"rendered":"UK &#8211; compound penalty of \u00a3569,157 imposed on named energy company"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The UK&#8217;s HM Revenue and Customs <a href=\"https:\/\/www.gov.uk\/government\/publications\/notice-to-exporters-202615-firm-named-after-russia-sanctions-breach-settlement\/notice-to-exporters-202615-firm-named-after-russia-sanctions-breach-settlement\">has announced<\/a> the imposition of a compound penalty of \u00a3569,157 on Petrofac Facilities Management Limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the first time, in a long time, that HMRC has named the recipient of a compound penalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The breaches took place in 2022 and 2023 with the company supplying prohibited goods to individuals connected with Russia and also providing technical assistance in relation to those goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company subsequently self-reported and cooperated with the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The change in naming policy is addressed:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<em>Naming those involved brings us into line with other enforcement partners whilst sending a clear message on the consequences of breaching sanctions rules<\/em>.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Notice further states that &#8220;<em>Where appropriate, HMRC will now include naming as a condition when offering a compound settlement for strategic export and sanctions offences<\/em>&#8220;. It appears that naming will now become more common if not done universally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Notice also gives helpful guidance on when HMRC will consider a compound penalty rather than prosecution, noting that a penalty will only be pursued where HMRC considers it has enough evidence to prosecute, and other considerations, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the seriousness of the alleged offence;<\/li>\n\n\n\n<li>whether fraudulent intent can be proven;<\/li>\n\n\n\n<li>the extent of the efforts to perpetrate the alleged offence;<\/li>\n\n\n\n<li>the type and value of any goods involved;<\/li>\n\n\n\n<li>the offender\u2019s previous history;<\/li>\n\n\n\n<li>the extent to which the offender has co-operated with any investigation; and<\/li>\n\n\n\n<li>the level of financial penalties known to have been imposed by courts for similar offences.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The UK&#8217;s HM Revenue and Customs has announced the imposition of a compound penalty of \u00a3569,157 on Petrofac Facilities Management Limited.
