{"id":1302,"date":"2026-07-30T08:01:59","date_gmt":"2026-07-30T12:01:59","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/?p=1302"},"modified":"2026-07-30T08:02:01","modified_gmt":"2026-07-30T12:02:01","slug":"united-kingdom-6-4m-fine-for-strategic-export-control-failures","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2026\/07\/30\/united-kingdom-6-4m-fine-for-strategic-export-control-failures\/","title":{"rendered":"United Kingdom &#8211; \u00a36.4m fine for strategic export control failures"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Further to our <a href=\"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2024\/07\/31\/uk-investigation-by-hmrc-into-potential-airbus-violations-of-export-controls\/\">earlier post reporting<\/a> on the UK&#8217;s investigation into Airbus, HMRC has today issued a <a href=\"https:\/\/www.gov.uk\/government\/publications\/notice-to-exporters-202617-compound-settlement-for-breaches-of-export-control\/notice-to-exporters-202617-compound-settlement-for-breaches-of-export-control\">Notice to Exporter<\/a>s that Airbus Operations Limited (AOL) has entered into a compound settlement with HMRC under which it will pay a fine of \u00a36,409,388 for offences under The Export Control Order 2008.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the largest fine imposed by HMRC under the compound settlement regime, and is another example of the new practice of sometimes naming companies that enter into such settlements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The offences do not relate to sanctions but to the UK&#8217;s strategic export controls regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The breaches took place &#8220;over a sustained period&#8221; before November 2022 and were self-reported by AOL which cooperated with the investigation and has implemented remediation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The breaches are described in only general terms as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 29(2)(a-g) on multiple occasions for failing to keep accurate records of transfers of controlled technology as per the conditions of three of their Open General Export Licences (OGELs)<\/li>\n\n\n\n<li>Article 29(3) on multiple occasions for failing to keep registers in relation to their OGELs<\/li>\n\n\n\n<li>Article 29(2)(i) on multiple occasions for failing to keep accurate records contrary to the conditions of one of their OGELs<\/li>\n\n\n\n<li>a Standard Individual Export Licence (SIEL) on one occasion, relating to a failure of licence conditions<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Further to our earlier post reporting on the UK&#8217;s investigation into Airbus, HMRC has today issued a Notice to Exporters that Airbus Operations Limited (AOL) has entered into a compound settlement with HMRC under which it will pay a fine of \u00a36,409,388 for offences under The Export Control Order 2008.
