{"id":542,"date":"2024-04-16T08:48:19","date_gmt":"2024-04-16T12:48:19","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/?p=542"},"modified":"2024-04-16T08:48:19","modified_gmt":"2024-04-16T12:48:19","slug":"netherlands-company-convicted-of-sanctions-breaches-ordered-to-be-liquidated","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2024\/04\/16\/netherlands-company-convicted-of-sanctions-breaches-ordered-to-be-liquidated\/","title":{"rendered":"Netherlands &#8211; company convicted of sanctions breaches ordered to be liquidated"},"content":{"rendered":"<p>As per <a href=\"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2023\/11\/15\/netherlands-authorities-apply-to-wind-up-company-fined-for-sanctions-breaches\/\">our earlier post<\/a>, in November last year the Public Prosecution Service in the Netherlands applied to wind up a company convicted of breaching the EU&#8217;s sanctions by unlawfully exporting goods to Russia.<\/p>\n<p>Yesterday, the District Court of Gelderland issued its <a href=\"https:\/\/uitspraken.rechtspraak.nl\/details?id=ECLI:NL:RBGEL:2024:2151&amp;showbutton=true&amp;keyword=Sanctiewet&amp;idx=1\">order and judgment<\/a> in the case. The court granted the application to wind up the company and appointed a liquidator to oversee the process.<\/p>\n<p>The court noted that the company had ceased to trade and that its director and shareholder (also convicted) had fled the Netherlands for Russia.<\/p>\n<p>The court did not grant the Prosecution&#8217;s application to immediately turn over all funds in the company&#8217;s bank accounts as the proceeds of crime.
