{"id":920,"date":"2025-05-01T05:38:05","date_gmt":"2025-05-01T09:38:05","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/?p=920"},"modified":"2025-05-01T05:38:06","modified_gmt":"2025-05-01T09:38:06","slug":"netherlands-appeal-brought-to-increase-18-month-sentence-for-russian-exports","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2025\/05\/01\/netherlands-appeal-brought-to-increase-18-month-sentence-for-russian-exports\/","title":{"rendered":"Netherlands &#8211; appeal brought to increase 18 month sentence for Russian exports"},"content":{"rendered":"\n<p>In <a href=\"https:\/\/blogs.duanemorris.com\/europeansanctionsenforcement\/2023\/11\/01\/netherlands-custodial-sentence-and-corporate-fine\/\">an earlier post<\/a>, we reported on the October 2023 sentence of an individual to 18 months in jail, and a fine of \u20ac200,000 imposed on the company operated by the individual.<\/p>\n\n\n\n<p>It is now <a href=\"https:\/\/www.linkedin.com\/pulse\/dutch-prosecutors-demand-3-year-sentence-professional-ml3ce\/\">being reported<\/a> that an appeal has been brought by the Dutch Public Prosecution Service (the &#8220;OM&#8221;) seeking to increase the sentence.<\/p>\n\n\n\n<p>The OM are seeking a three-year custodial sentence, a five-year ban from the individual acting as a director, and confiscation of \u20ac72,697.71 of the proceeds of the sanctions breaches. <\/p>\n\n\n\n<p>It is reported that the appeal is based on the deliberate nature of the offending with the export of sanctioned goods to Russia via third countries including the Maldives and Kazakhstan.<\/p>\n\n\n\n<p>There is no appeal in relation to the fine of \u20ac200,000 imposed on Woerd-Tech BV.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In an earlier post, we reported on the October 2023 sentence of an individual to 18 months in jail, and a fine of \u20ac200,000 imposed on the company operated by the individual.
