{"id":257,"date":"2015-12-15T15:27:03","date_gmt":"2015-12-15T19:27:03","guid":{"rendered":"http:\/\/blogs.duanemorris.com\/gaminglaw\/?p=257"},"modified":"2015-12-15T15:27:03","modified_gmt":"2015-12-15T19:27:03","slug":"new-jersey-assembly-offers-its-version-of-north-jersey-casino-expansion","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/gaminglaw\/2015\/12\/15\/new-jersey-assembly-offers-its-version-of-north-jersey-casino-expansion\/","title":{"rendered":"New Jersey Assembly Offers its Version of North Jersey Casino Expansion"},"content":{"rendered":"<p>Just days following a proposed amendment to the New Jersey State Constitution proposed in the State Senate and as detailed <a href=\"http:\/\/blogs.duanemorris.com\/gaminglaw\/2015\/12\/11\/new-jersey-legislature-takes-first-step-to-authorize-north-jersey-casinos\/\" target=\"_blank\">here<\/a> , the New Jersey Assembly offered its own proposed Amendment to the Constitution which would also authorize up to two additional casinos in North Jersey.<\/p>\n<p>Both Amendments propose no more the two casinos, each located in different counties and outside a 75 mile radius of Atlantic City.\u00a0 The 75 mile radius restriction eliminates Monmouth Park Racetrack as a possible site for casino expansion.<\/p>\n<p>The primary differences are as follows;<\/p>\n<ul>\n<ul style=\"font: 16px\/24px 'Source Sans Pro', Helvetica, sans-serif;margin: 0px;padding: 0px 0px 0px 40px;text-align: left;color: #141412;text-indent: 0px;letter-spacing: normal;background-color: #ffffff\">\n<li><strong>Applicant eligibility<\/strong>:\u00a0 The Assembly version of the proposed amendment allows one of the two licenses to be awarded to an applicant with no current ownership or ties to an existing Atlantic City casino.\u00a0 The Senate version of the amendment limits eligibility to (1)\u00a0a currently licensed Atlantic City casino operating as of December 11, 2015; or\u00a0(2) <span style=\"font: 16px\/24px 'Source Sans Pro', Helvetica, sans-serif;text-align: left;color: #141412;text-indent: 0px;letter-spacing: normal;float: none;background-color: #ffffff\">any person licensed as a principal owner (<\/span><em style=\"text-align: left;color: #141412;line-height: 24px;text-indent: 0px;letter-spacing: normal;font-family: 'Source Sans Pro', Helvetica, sans-serif;font-size: 16px;font-variant: normal;font-weight: normal;background-color: #ffffff\">yet undefined<\/em><span style=\"font: 16px\/24px 'Source Sans Pro', Helvetica, sans-serif;text-align: left;color: #141412;text-indent: 0px;letter-spacing: normal;float: none;background-color: #ffffff\">) of a holder of a New Jersey casino license that was operating a casino which was conducting gambling on December 11, 2015 if that principal owner also holds a valid license to own and operate a casino in another jurisdiction with licensing standards similar to those in New Jersey.\u00a0 The Assembly version only applies the Senate version&#8217;s\u00a0proposed eligibility requirements to the &#8220;initial license.&#8221;\u00a0 The current Atlantic City casino tie-in eligibility requirement presumably does not apply to the second license awarded.<\/span><\/li>\n<li><strong>Tax Allocation to Atlantic City.<\/strong>\u00a0\u00a0The Assembly version of the proposed Constitutional Amendment allocates 35% of state tax revenuers from the two new casinos for purposes if the recovery, stabilization or improvement of Atlantic\u00a0 City.\u00a0 The Senate version\u00a0 allocate 49% of such tax revenue for the recovery, stabilization or improvement of Atlantic\u00a0 City.<\/li>\n<\/ul>\n<\/ul>\n<p><span style=\"font: 16px\/24px 'Source Sans Pro', Helvetica, sans-serif;text-align: left;color: #141412;text-indent: 0px;letter-spacing: normal;float: none;background-color: #ffffff\">The Senate and Assembly must agree on\u00a0an identical version of the proposed Amendment which would have to be approved with 3\/5 votes by both houses of the NJ Legislature or majority votes, twice over two years.\u00a0 The votes have to be completed at least 90 days before going on the ballot of a state-wide referendum to amend the NJ State Constitution.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Just days following a proposed amendment to the New Jersey State Constitution proposed in the State Senate and as detailed here , the New Jersey Assembly offered its own proposed Amendment to the Constitution which would also authorize up to two additional casinos in North Jersey.
