Heidtke<\/a><\/strong><\/em><\/p>\n<p class=\"DMBdyTxt\">We previously wrote about the growing number of lawsuits by insureds seeking business interruption insurance coverage for business losses in response to the novel coronavirus (<a href=\"https:\/\/www.duanemorris.com\/alerts\/heating_up_new_orleans_based_oceana_grill_seeks_insurance_coverage_coronavirus_caused_0320.html\">here<\/a> and <a href=\"https:\/\/blogs.duanemorris.com\/insurancelaw\/2020\/04\/21\/coronavirus-business-interruption-litigation-ramping-up-to-include-several-class-action-suits-against-single-insurers\/\">here<\/a>), and<a href=\"https:\/\/blogs.duanemorris.com\/insurancelaw\/2020\/03\/24\/statutes-compelling-coronavirus-business-interruption-insurance-should-face-constitutional-constraints\/\" target=\"_blank\" rel=\"noopener noreferrer\"> the constraints that state and federal governments should face were they to compel such coverage<\/a>. We also previously <a href=\"https:\/\/blogs.duanemorris.com\/insurancelaw\/2020\/03\/24\/statutes-compelling-coronavirus-business-interruption-insurance-should-face-constitutional-constraints\/\" target=\"_blank\" rel=\"noopener noreferrer\">detailed<\/a> nationwide efforts aimed at enacting legislation compelling business interruption and contingent business interruption insurance for COVID-19 losses.<\/p>\n<p class=\"DMBdyTxt\">As of the date of this update, eight states have proposed a number of bills relating to business interruption insurance.<!--more--> Those states include Louisiana (<a href=\"https:\/\/www.legis.la.gov\/legis\/ViewDocument.aspx?d=1168164\">SB477<\/a>; <a href=\"https:\/\/legiscan.com\/LA\/text\/HB858\/2020\">HB858<\/a>), Massachusetts (<a href=\"https:\/\/malegislature.gov\/Bills\/191\/S2655\">SD2655<\/a>; <a href=\"https:\/\/malegislature.gov\/Bills\/191\/SD2888\">SD2888<\/a>), Michigan (<a href=\"http:\/\/www.legislature.mi.gov\/(S(5ar4z4tspbfail0urtalt52x))\/mileg.aspx?page=GetObject&amp;objectname=2020-HB-5739\">HB5739<\/a>), New Jersey (<a href=\"https:\/\/www.njleg.state.nj.us\/2020\/Bills\/A4000\/3844_I1.HTM\">AB3844<\/a>), New York (<a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A10226&amp;term=2019&amp;Summary=Y&amp;Actions=Y&amp;Committee%26nbspVotes=Y&amp;Text=Y\">AB10226<\/a>; <a href=\"https:\/\/legiscan.com\/NY\/bill\/S08211\/2019\">SB8211<\/a>), Ohio (<a href=\"https:\/\/www.legislature.ohio.gov\/legislation\/legislation-summary?id=GA133-HB-589\">HB589<\/a>), Pennsylvania (<a href=\"https:\/\/www.legis.state.pa.us\/CFDOCS\/Legis\/PN\/Public\/btCheck.cfm?txtType=PDF&amp;sessYr=2019&amp;sessInd=0&amp;billBody=H&amp;billTyp=B&amp;billNbr=2372&amp;pn=3512\">HB2372<\/a>), and South Carolina (<a href=\"https:\/\/www.scstatehouse.gov\/sess123_2019-2020\/bills\/1188.htm\">SB1188<\/a>). The proposed bills in each of the aforementioned states have been referred to various legislative committees, with Louisiana\u2019s Senate Insurance Committee set to consider SB477 on May 13, 2020.<\/p>\n<p class=\"DMBdyTxt\">Not to be outdone, U.S. Congress also waded into the mix. We <a href=\"https:\/\/blogs.duanemorris.com\/insurancelaw\/2020\/04\/16\/congress-proposes-bill-for-coronavirus-business-interruption-insurance-coverage\/\">previously<\/a> wrote about HR 6494, labeled the \u201cBusiness Interruption Insurance Coverage Act of 2020\u201d. The \u201cNever Again Small Business Protection Act of 2020,\u201d <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/6497\/text?r=3&amp;s=1\">HR 6497<\/a>, was also recently introduced.<\/p>\n<p class=\"DMBdyTxt\">HR 6497, as drafted, requires any insurer that \u201coffers or makes available business interruption insurance coverage\u201d to \u201cmake available\u201d \u201coptional additional coverage\u201d that covers losses resulting from \u201cbusiness interruption due to any order, by any officer or agency of the Federal Government or of any State or local government, requiring cessation of operations during a national emergency.\u201d HR 6497 directs the Treasury Department to undertake a study \u201cregarding the effectiveness and efficiency of using a Federal backstop mechanism, private equity pools, risk assessments, and market pricing to reinsure insurers for excessive losses\u201d that could be caused by the mandate that insurers provide the \u201coptional additional coverage\u201d described in Section 2 of HR 6497. Unlike other proposed bills, HR 6497 precludes a business from obtaining the \u201coptional additional coverage\u201d if that business involuntarily terminated an employee or terminated the health care insurance coverage of any employee during the period that the national emergency was in effect. Both HR 6494 and HR 6497 have been referred to the House Insurance Committee.<\/p>\n<p class=\"DMBdyTxt\">In addition to HR 6494 and HR 6497, several weeks ago, Carolyn Maloney (D-N.Y.) circulated a draft bill labeled the \u201cPandemic Risk Insurance Act of 2020,\u201d but the draft has not been formally introduced.<\/p>\n<p class=\"DMBdyTxt\">While it appears that legislative efforts have begun to slow from the hurried pace seen in March and April, we continue to monitor and evaluate these developments.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By\u00a0Dominica C.
