Hellerstedt; Duane Morris Amicus Brief Cited in Opinion"},"content":{"rendered":"<p>In a 5-3 decision today, the Supreme Court of the United States in <a href=\"http:\/\/www.supremecourt.gov\/opinions\/15pdf\/15-274_p8k0.pdf\"><em>Whole Woman\u2019s Health v. Hellerstedt<\/em><\/a>, No. 15-275, slip op. (June 27, 2016) reversed a decision of the Fifth Circuit and overturned as unconstitutional a Texas law that (1) required physicians to have \u201cactive admitting privileges\u201d at a hospital within 30 miles of the location at which they provide abortions and (2) required facilities to meet standards adopted for ambulatory surgery centers. The Court wrote that each of the requirements \u201cplaces a substantial obstacle in the path of women seeking a previability abortion, each constitutes an undue burden on abortion access, and each violates the Federal Constitution.\u201d\u00a0 A team of Duane Morris attorneys, including <a href=\"http:\/\/www.duanemorris.com\/attorneys\/philiphlebowitz.html\">Philip H. Lebowitz<\/a>, <a href=\"http:\/\/www.duanemorris.com\/attorneys\/erinmduffy.html\">Erin M. Duffy<\/a>, <a href=\"http:\/\/www.duanemorris.com\/attorneys\/katharynichristianmcgee.html\">Katharyn I. Christian McGee<\/a>, <a href=\"http:\/\/www.duanemorris.com\/attorneys\/alisontrosenblum.html\">Alison Taylor Rosenblum<\/a>, and <a href=\"http:\/\/www.duanemorris.com\/attorneys\/ericafruiterman.html\">Erica Fruiterman<\/a>, filed an <em>amicus curiae <\/em>brief pro bono on behalf of medical staff professionals in support of petitioners Whole Woman\u2019s Health, et al. discussing the credentialing and admitting privileges process for physicians.\u00a0 In its decision, the Supreme Court cited <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/supreme_court_preview\/briefs_2015_2016\/15-274_amicus_pet_MedicalStaffProfessionals.authcheckdam.pdf\">Duane Morris\u2019 <em>amicus <\/em>brief<\/a>, noting, \u201cOther amicus briefs filed here set forth without dispute other common prerequisites to obtaining admitting privileges that have nothing to do with ability to perform medical procedures.\u201d \u00a0The brief was one of only a handful of <em>amici curiae <\/em>briefs cited in the decision out of a total of <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/whole-womans-health-v-cole\/\">41 such briefs<\/a> filed on behalf of petitioners.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a 5-3 decision today, the Supreme Court of the United States in Whole Woman\u2019s Health v.
