{"id":126,"date":"2024-08-30T16:01:07","date_gmt":"2024-08-30T20:01:07","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/?p=126"},"modified":"2024-08-30T16:01:07","modified_gmt":"2024-08-30T20:01:07","slug":"eight-state-attorneys-general-join-doj-antitrust-lawsuit-against-realpage","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/2024\/08\/30\/eight-state-attorneys-general-join-doj-antitrust-lawsuit-against-realpage\/","title":{"rendered":"Eight State Attorneys General Join DOJ Antitrust Lawsuit Against RealPage"},"content":{"rendered":"<p>On August 23, 2024, the Attorneys General of North Carolina, California, Colorado, Connecticut, Minnesota, Oregon, Tennessee, and Washington, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-sues-realpage-algorithmic-pricing-scheme-harms-millions-american-renters\">joined the DOJ Antitrust Division<\/a> in suing RealPage, Inc., alleging an unlawful scheme to decrease competition among landlords in apartment pricing and to monopolize the market for commercial revenue management software that landlords use to price apartments.<\/p>\n<p>The <a href=\"https:\/\/www.justice.gov\/opa\/media\/1364976\/dl?inline\">complaint<\/a> alleges that landlords share with RealPage their nonpublic, competitively sensitive data, which RealPage then uses to generate rental pricing recommendations, suppressing competition among landlords to the detriment of renters throughout the country.\u00a0 The state attorneys general assert their independent authority under Section 16 of the Clayton Act to bring actions to obtain injunctive relief for violations of Sections 1 and 2 of the Sherman Act.<\/p>\n<p>The attorneys general of the District of Columbia and Arizona previously sued RealPage for the same conduct, in <a href=\"https:\/\/oag.dc.gov\/release\/attorney-general-schwalb-sues-realpage-residential\">November 2023<\/a> and <a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mayes-sues-realpage-and-residential-landlords-illegal-price-fixing\">February 2024<\/a>, respectively.\u00a0 Those lawsuits\u2014like a complaint filed by a proposed class of renters in October 2022\u2014allege that RealPage\u2019s conduct constitutes <em>per se<\/em> price-fixing.
