{"id":179,"date":"2025-04-14T14:33:06","date_gmt":"2025-04-14T18:33:06","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/?p=179"},"modified":"2025-04-14T14:34:47","modified_gmt":"2025-04-14T18:34:47","slug":"group-of-attorneys-general-sue-trump-administration-to-allow-access-to-funds-to-address-long-term-effects-of-covid-19-on-k-12-children","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/2025\/04\/14\/group-of-attorneys-general-sue-trump-administration-to-allow-access-to-funds-to-address-long-term-effects-of-covid-19-on-k-12-children\/","title":{"rendered":"Group of Attorneys General Sue Trump Administration to Allow Access to Funds to Address Long-Term Effects of Covid-19 on K-12 Children"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On April 10, a group of Democratic state attorneys general, along with Pennsylvania Governor Josh Shapiro, <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/court-filings\/state-of-new-york-et-al-v-united-states-department-of-education-linda-mcmahon-complaint-2025.pdf\" data-type=\"link\" data-id=\"https:\/\/ag.ny.gov\/sites\/default\/files\/court-filings\/state-of-new-york-et-al-v-united-states-department-of-education-linda-mcmahon-complaint-2025.pdf\">sued<\/a> the Trump Administration over access to previously-approved funding to address the long -term effects of Covid-19 on elementary and high school students.&nbsp; On March 28, the Department of Education sent a letter to the plaintiff states notifying them that they could no longer access the funds, totaling $1.1 billion, under programs enacted as part of the Biden Administration\u2019s Covid relief plan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/letters\/united-states-department-of-education-letter-to-chiefs-of-staffs-of-education-letter-2025.pdf\">letter rescinding the funding<\/a> had stated that \u201cthe COVID pandemic [has already] ended,\u201d and therefore extending deadlines for COVID-related grants \u201cis not consistent with the Department\u2019s priorities and thus not a worthwhile exercise of its discretion.\u201d \u00a0But the Complaint alleges that many of the areas of focus for the funding \u201care not tied to the duration of the public health emergency, including evidence-based interventions (such as summer learning, extended day programs, and afterschool initiatives) intended to mitigate the long-term effects of learning disruptions caused by the pandemic; addressing academic, social, emotional, and mental health needs, especially for marginalized groups like low-income students; and providing educational technology to enhance learning environments.\u201d\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Department of Education had previously said that the states could access the funds through March 2026.&nbsp; The Complaint seeks an order vacating and setting aside the Department of Education\u2019s rescission letter, and an injunction precluding the Department from taking any action to prevent the states from accessing the funds through March 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs include New York, Arizona, California, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, Oregon, Pennsylvania (through Governor Shapiro, acting in his official capacity), and the District of Columbia.&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On April 10, a group of Democratic state attorneys general, along with Pennsylvania Governor Josh Shapiro, sued the Trump Administration over access to previously-approved funding to address the long -term effects of Covid-19 on elementary and high school students.&nbsp; On March 28, the Department of Education sent a letter to the plaintiff states notifying them &hellip; <\/p>\n<p class=\"link-more\"><a href=\"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/2025\/04\/14\/group-of-attorneys-general-sue-trump-administration-to-allow-access-to-funds-to-address-long-term-effects-of-covid-19-on-k-12-children\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Group of Attorneys General Sue Trump Administration to Allow Access to Funds to Address Long-Term Effects of Covid-19 on K-12 Children&#8221;<\/span><\/a><\/p>\n","protected":false},"author":341,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[],"ppma_author":[8],"class_list":["post-179","post","type-post","status-publish","format-standard","hentry","category-general"],"authors":[{"term_id":8,"user_id":341,"is_guest":0,"slug":"chcasey","display_name":"Christopher H.
