{"id":187,"date":"2025-05-15T17:55:36","date_gmt":"2025-05-15T21:55:36","guid":{"rendered":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/?p=187"},"modified":"2025-05-15T17:55:36","modified_gmt":"2025-05-15T21:55:36","slug":"20-democratic-state-ags-sue-trump-administration-over-conditions-on-dhs-and-dot-funding-to-states","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/stateattorneysgeneral\/2025\/05\/15\/20-democratic-state-ags-sue-trump-administration-over-conditions-on-dhs-and-dot-funding-to-states\/","title":{"rendered":"20 Democratic State AGs Sue Trump Administration Over Conditions on DHS and DOT Funding to States"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In <a href=\"https:\/\/www.law360.com\/articles\/2339264\/attachments\/0\">separate<\/a> <a href=\"https:\/\/www.law360.com\/articles\/2339264\/attachments\/1\">lawsuits<\/a> filed on May 13, 20 Democratic state attorneys general sued the Trump Administration for conditioning their states\u2019 receipt of funding appropriated by Congress for the Department of Homeland Security (DHS) and the Department of Transportation (DOT) on the states\u2019 enforcing the President\u2019s immigration agenda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The states claim that the Trump Administration is unconstitutionally holding billions of dollars in their share of funding for DHS and DOT \u201chostage\u201d by conditioning the states\u2019 receipt of those funds on whether the states comply with a set of conditions requiring them to assist in federal civil immigration enforcement.&nbsp; The lawsuits claim that the conditions on the funding are unconstitutionally vague and violate the separation of powers by encroaching on Congress\u2019 power to set funding requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The complaint against the DOT alleges that the funding that is subject to the immigration-related conditions is \u201cessential to sustain critical public safety and transportation programs, including highway development, airport safety projects, protections against train collisions, and programs to prevent injuries and deaths from traffic accidents.\u201d &nbsp;The complaint against DHS alleges that the plaintiff states rely on DHS funding to \u201cprepare for, protect against, respond to, and recover from catastrophic disasters.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The states seek a declaratory judgment that the conditions imposed on the funding are unlawful and prospective injunctive relief on enforcement of the conditions.&nbsp; The states bringing the two lawsuits include California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Washington, Wisconsin and Vermont.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In separate lawsuits filed on May 13, 20 Democratic state attorneys general sued the Trump Administration for conditioning their states\u2019 receipt of funding appropriated by Congress for the Department of Homeland Security (DHS) and the Department of Transportation (DOT) on the states\u2019 enforcing the President\u2019s immigration agenda.
