{"id":86,"date":"2015-12-15T14:57:38","date_gmt":"2015-12-15T18:57:38","guid":{"rendered":"http:\/\/blogs.duanemorris.com\/thelegaldish\/?p=86"},"modified":"2020-08-04T17:34:45","modified_gmt":"2020-08-04T21:34:45","slug":"the-great-sushi-swindle","status":"publish","type":"post","link":"https:\/\/blogs.duanemorris.com\/thelegaldish\/2015\/12\/15\/the-great-sushi-swindle\/","title":{"rendered":"The Great Sushi Swindle"},"content":{"rendered":"<p><em><strong>By Constantine Mittendorf<\/strong><\/em><\/p>\n<p><a href=\"http:\/\/blogs.duanemorris.com\/thelegaldish\/wp-content\/uploads\/sites\/31\/2015\/12\/Sushi-Photo1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-87 aligncenter\" src=\"http:\/\/blogs.duanemorris.com\/thelegaldish\/wp-content\/uploads\/sites\/31\/2015\/12\/Sushi-Photo1-300x206.jpg\" alt=\"Sushi Photo1\" width=\"194\" height=\"133\" srcset=\"https:\/\/blogs.duanemorris.com\/thelegaldish\/wp-content\/uploads\/sites\/31\/2015\/12\/Sushi-Photo1-300x206.jpg 300w, https:\/\/blogs.duanemorris.com\/thelegaldish\/wp-content\/uploads\/sites\/31\/2015\/12\/Sushi-Photo1.jpg 770w\" sizes=\"auto, (max-width: 194px) 100vw, 194px\" \/><\/a><\/p>\n<p>Ever wonder if that sashimi you ordered is really bluefin tuna?\u00a0 \u00a0Well, the San Diego County City Attorney\u2019s Office recently announced that it has been <a href=\"http:\/\/www.sandiego.gov\/cityattorney\/pdf\/news\/2015\/nr151207a.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><u>criminally prosecuting<\/u><\/a> instances of sushi mislabeling.<\/p>\n<blockquote><p><em>&#8220;DNA testing found that one-third (33 percent) of the 1,215 samples analyzed nationwide were mislabeled<\/em>&#8220;<\/p><\/blockquote>\n<p style=\"text-align: justify;\"><!--more-->As you may know, mislabeling fish in sushi restaurants is not uncommon.\u00a0 Fish can vary widely in price depending on the species, but can appear to be very similar when cut into a fillet.\u00a0 For example, red snapper is more expensive than farmed tilapia, but it\u2019s hard to tell the difference when served in a sushi roll.\u00a0 This has tempted many sushi restaurants to falsely market their sushi menus as including expensive delicacies, when they really serve a cheap imitation.<\/p>\n<p style=\"text-align: justify;\">In fact in 2012, Oceana (an ocean conservation and advocacy organization) published a major <a href=\"http:\/\/oceana.org\/reports\/oceana-study-reveals-seafood-fraud-nationwide\" target=\"_blank\" rel=\"noopener noreferrer\"><u>seafood fraud investigation<\/u><\/a> to determine if fish was honestly labeled in retail outlets and restaurants.\u00a0 According to the study:<\/p>\n<p style=\"text-align: justify;\">\u201c<em>DNA testing found that one-third (33 percent) of the 1,215 samples analyzed nationwide were mislabeled, according to U.S. Food and Drug Administration (FDA) guidelines. Of the most commonly collected fish types, samples sold as snapper and tuna had the highest mislabeling rates (87 and 59 percent, respectively), with the majority of the samples identified by DNA analysis as something other than what was found on the label.\u00a0 In fact, only seven of the 120 samples of red snapper purchased nationwide were actually red snapper.
