Rosenstein\u00a0<a title=\"Deputy Attorney General Rosenstein's remarks\" href=\"https:\/\/www.justice.gov\/opa\/speech\/deputy-attorney-general-rod-j-rosenstein-delivers-remarks-american-conference-institute-0\" target=\"_blank\" rel=\"noopener\">announced<\/a>\u00a0the Department of Justice\u2019s (DOJ) much-anticipated revisions to the September 2015 Memorandum on \u201c<a title=\"Individual Accountability for Corporate Wrongdoing\" href=\"https:\/\/www.justice.gov\/archives\/dag\/file\/769036\/download\" target=\"_blank\" rel=\"noopener\">Individual Accountability for Corporate Wrongdoing<\/a>,\u201d commonly known as the \u201cYates Memo\u201d and named for Rosenstein\u2019s predecessor, Sally Q. Yates. The Yates Memo emphasized the importance of holding individuals accountable for corporate misconduct, and set forth principles for DOJ prosecutors to follow in determining when corporations would qualify for \u201ccooperation credit\u201d in corporate criminal and civil investigations. The most significant\u2014and controversial\u2014provision in the Yates Memo required that \u201cin order to qualify for any cooperation credit, corporations must provide to the Department all relevant facts relating to the individuals responsible for the misconduct.\u201d The new policy announced by Rosenstein modifies this \u201call or nothing\u201d approach to cooperation credit by giving DOJ prosecutors and civil attorneys more flexibility.<\/p>\n<p>In announcing the new policy, Rosenstein reaffirmed the Department\u2019s commitment to prosecuting individual wrongdoers, stating that, \u201cThe most effective deterrent to corporate criminal misconduct is identifying and punishing the people who committed the crimes.\u201d However, he stated that the lack of flexibility in the Yates Memo\u2019s approach impeded resolutions and wasted resources, and in some cases was not strictly enforced.<\/p>\n<p><a href=\"https:\/\/www.duanemorris.com\/alerts\/doj_eases_yates_memos_all_or_nothing_approach_corporate_cooperation_credit_1218.html\">Visit the Duane Morris LLP website to read the full <em>Alert<\/em><\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On November 29, 2018, Deputy Attorney General Rod J.
