Health concerns over the lingering COVID-19 pandemic have given life to Rule 30(b)(4) of the Federal Rules of Civil Procedure, which provides: “The parties may stipulate—or the court may on motion order—that a deposition be taken by telephone or other remote means.” Trial courts in the Second Circuit are encouraging parties to stipulate to remote depositions to minimize the risks of COVID-19 exposure, with some courts ordering remote depositions as the default in pending cases.

Earlier today, Gov. Phil Murphy announced that indoor dining will no longer be permitted later this week as part of New Jersey’s Reopening Plan. Initially, indoor dining was supposed to be able to resume this week on Thursday, in time for the Fourth of July weekend. Given the rising number of cases in other States and the crowds expected this weekend for the 4th of July, the Governor has opted to slow down the reopening of indoor dining.

On June 24, 2020, the Treasury Department and Small Business Administration released an interim final rule updating eligibility criteria for Paycheck Protection Program (PPP) loans made under the Coronavirus Aid, Relief and Economic Security Act (CARES Act) and the Paycheck Protection Program Flexibility Act.
The June 24 interim final rule loosens the eligibility criteria that applied to owners of 20 percent or more of a PPP loan borrower’s equity, specifically concerning the criminal histories of such owners. In addition, the June 24 interim final rule confirms certain other eligibility criteria that will remain in place.
