New Jersey Announces Required Safety Protocols for Reopening Businesses

On June 3, 2020, New Jersey Governor Phil Murphy unveiled specific safety protocols that certain businesses must follow as they reopen later this month. Specifically, Governor Murphy executed Executive Order 20-150, which will allow nonessential retail and outdoor dining to reopen on June 15. The Order specifies the requirements necessary for such businesses to commence operations on June 15. Governor Murphy also announced that hair salons and barbershops will be allowed to reopen on June 22.

Maryland Enters Stage Two of Reopening Plan, Lifting Restrictions for Nonessential Businesses, Subject to Local Orders

On June 3, 2020, Maryland Governor Larry Hogan announced that effective Friday, June 5, 2020, at 5:00 p.m., the state would begin stage two of the its three-stage recovery plan. Maryland began stage one three weeks ago, when Governor Hogan lifted the stay-at-home order that had been in place since March 30, 2020.

Maryland Governor Announces State Will Complete Stage One of Reopening Plan, Subject to Local Orders

On May 27, 2020, Maryland Governor Larry Hogan announced that effective May 29, 2020, at 5:00 p.m., the state would move forward with the completion of stage one of its three-stage recovery plan. Maryland began stage one of the recovery plan two weeks ago, when Governor Hogan lifted the stay-at-home order that had been in place since March 30, 2020, and permitted certain businesses to reopen with limitations.

Philadelphia Begins Re-Opening Process for Restaurants, Lifts Stay at Home Order

s of May 26, 2020, Philadelphia Mayor Jim Kenney amended his earlier business closure and stay-at-home orders and will now permit up to 10 people to line up to order at restaurants and food establishments. Dine-in service is still prohibited, and face coverings and social distancing guidelines are required.

The amendment follows Gov. Tom Wolf’s announced plans last week to move all Pennsylvania counties, including the five-county Philadelphia region, to the yellow phase of reopening and lift stay-at-home orders by June 5.

CDC Issues ‘Decision Tree’ to Assist Employers with Reopening Decisions

On May 14, 2020, the Centers for Disease Control and Prevention (CDC) finally published guidance in the form of a one-page workplace decision tree. Although the document―entitled “Workplaces During the COVID-19 Pandemic”―provides high-level recommendations for employers to consider when reopening, it largely defers to state and local guidance and is a far cry from the substantially more detailed guidance documents that the CDC reportedly had been considering in recent weeks.

Pennsylvania Permits Reopening of Real Estate Businesses Per Published Guidelines

On May 19th, Governor Tom Wolf announced that businesses and employees in the real estate industry may conduct limited business-related activities statewide and provided guidance for this industry to operate in red phase and yellow phase counties.

“Reopen Massachusetts” Permits Construction, Manufacturing and Places of Worship to Reopen

On May 18th, the Governor of Massachusetts released Reopening Massachusetts, which provides for a 4-phased strategy to reopen businesses and activities in Massachusetts. The Administration also released a new “Safer At Home” Advisory, which instructs residents to stay at home unless engaging in these newly opened activities. Starting May 18, 2020, Massachusetts will begin Phase 1 of reopening, and workplaces that are permitted to open are required to follow new safety protocols and guidance.

New Jersey Continues Reopening Program Permitting Additional Outdoor Activities and Businesses to Open

Governor Murphy signed Executive Order No. 147, allowing certain outdoor activities at recreational businesses, including archery ranges, batting cages, golf driving ranges, horseback riding, shooting ranges, and tennis clubs as well as community gardens to open with required social distancing measures in place. The EO takes effect on Friday, May 22 at 6:00 a.m.
