No State-Wide Shut-Down (Yet) in Texas, But Various Cities/Counties Issue “Stay Home” Orders

As of March 24, 2020, Texas Governor Greg Abbott had not ordered a statewide shelter-in-place order. However, numerous Texas cities (or their related county governments) such as Dallas, Fort Worth, Waco, Houston, Galveston, San Antonio, Austin and El Paso and close-in suburbs have issued “Stay Home – Work Safe” or “Stay Home – Stay Safe” orders. The orders command citizens of those particular jurisdictions to stay in their residences and state that they may leave only for essential activities, or to provide or perform essential governmental functions, or to operate essential businesses. Each of the orders is continued to various dates in April or until further notice.

Essential businesses typical include (but are not limited to) essential healthcare operations, essential governmental functions, essential critical infrastructure, essential retail such as grocery stores and pharmacies, food cultivation, financial institutions, mail and delivery services, hardware and supply stores, funeral services, providers of basic necessities to economically disadvantaged populations, news media, and child care, among others. Critical infrastructure may include construction, depending on the purpose.

On March 25, 2020, President Trump declared that a major disaster exists in Texas and ordered federal assistance to supplement state and local recovery efforts for COVID-19.

New Jersey Orders Citizens to Stay at Home Amid COVID-19 Pandemic

On March 21, 2020, Governor Phil Murphy issued Executive Order 107 mandating that New Jersey citizens stay home and that nonessential businesses close, with limited exceptions, until further notice. Governor Murphy also issued Executive Order 109, indefinitely postponing all elective surgeries and invasive medical procedures as of March 27, 2020. These restrictions are the state’s latest measures to curb the outbreak of the coronavirus (COVID-19).

Massachusetts to Close Nonessential Businesses and Issues “Stay at Home” Advisory

Governor Charlie Baker issued an emergency order closing all businesses and organizations in Massachusetts that do not provide COVID-19 essential services from 12:00 p.m. on March 24, until 12:00 p.m. on April 7. The order applies to physical workspaces and facilities and encourages businesses to operate remotely to the extent possible.

Mexico’s Judicial System Responds to COVID-19 with Partial Shutdown

On March 19, 2020, a Mexican district court judge issued an order to the federal government to take all necessary measures to prevent the spread of COVID-19 and detect people who have the infectious disease.

Furthermore, Mexico’s Supreme Court said in a March 17 statement that it would suspend its regular court activities from March 18 to April 19 to contain the spread of COVID-19.

The country’s other federal courts followed suit with a similar preventative announcement later on March 17, suspending activities over the same time period “with the aim of avoiding the concentration of people,” the courts said in a separate statement.

Maryland Governor Closes All Nonessential Businesses and Other Establishments March 23, 2020

Maryland Governor Larry Hogan issued an order to take effect at 5:00 p.m. on March 23, 2020, that will close all nonessential businesses, organizations and establishments in the state, in addition to businesses closed by previous executive orders. This follows previous orders, statewide actions and recommendations. The order excludes “Essential Critical Infrastructure” businesses as defined by the federal government, which include businesses in the following sectors: chemical, commercial facilities, communications, critical manufacturing, dams, defense industrial base, emergency services, energy, financial services, food and agriculture, government facilities, healthcare and public health, information technology, nuclear reactors, materials, and waste, transportation, and water and wastewater.

Illinois Governor Closes All But Essential Businesses and Organizations Over COVID-19

On March 20, 2020, Illinois Governor JB Pritzker issued Executive Order 2020-10 in response to COVID-19. Beginning at 5:00 p.m. on March 21, 2020, and continuing through April 7, 2020, at a minimum, the executive order requires that all individuals stay at home unless they work for essential businesses and operations.

Delaware Governor Closes Nonessential Businesses Until May 15, 2020

On March 22, 2020, Delaware Governor John Carney issued his Fourth and Fifth Modifications of the Declaration of a State of Emergency for the State of Delaware Due to a Public Health Threat, pursuant to which he has ordered the closure of nonessential business and commercial establishments in Delaware (Nonessential Business Closure Order). The order takes effect on Tuesday, March 24, 2020, at 8:00 a.m. and remains in effect “until after May 15, 2020, or the public health threat of COVID-19 has been eliminated… .” Violations of the Nonessential Business Closure Order constitute a criminal offense.

Gov. Wolf Revises Pennsylvania Non-Life-Sustaining Business Shutdown Order with Waivers Allowed

Pennsylvania Governor Tom Wolf has amended his March 19, 2020, order regarding the “Closure of All Businesses That Are Not Life Sustaining.” Commencement of enforcement actions against “non-life sustaining businesses that are out of compliance” was moved from March 21, 2020, at 12:01 a.m. to March 23, 2020, at 8:00 a.m., giving nonexempt businesses two additional days to prepare for closure or seek an exemption.

Delaware’s Governor Issues Closure Order for Non-Essential Businesses effective 8 AM on March 24, 2020

Governor John Carney issued his Forth Modification of the Declaration of a State of Emergency for the State of Delaware Due to a Public Health Threat, pursuant to which he has ordered the closure of non-essential business and commercial establishments in the state of Delaware (the “Non-Essential Business Closure Order”).

The order takes effect on Tuesday, March 24, 2002, at 8:00 a.m. and remains in effect “until after May 15, 2020, or the public health threat of COVID-19 has been eliminated . . . .” Violations of the Non-Essential Business Closure Order constitute a criminal offense.

Philadelphia Issues “Stay at Home” Order

As you have likely been following, New York and New Jersey have issued similar but slightly different Stay at Home orders over the weekend. Pennsylvania has also issued a “non-life supporting” business physical locations shut down effective as of Friday, March 20, 2020. The list of what constitutes a “life-sustaining” business has been modified twice since the initial announcement.

As of March 22, 2020, the City of Philadelphia has declared by Executive Order, a similar Stay at Home Order.
