Maryland Governor to Lift Stay-at-Home Order; Limited Businesses Permitted to Reopen, Subject to Local Orders

On May 13, 2020, Maryland Governor Larry Hogan announced that effective Friday, May 15, 2020, at 5:00 p.m., he will lift the stay-at-home order that has been in place in the state since March 30, 2020, and will permit certain businesses to reopen with limitations. The announcement marks the launch of stage one of the state’s three-stage recovery plan that Governor Hogan announced on April 24, 2020.

U.S. Dept. of Education Office of Civil Rights Issues FAQ Regarding Civil Rights and Distance Learning During COVID-19

The U.S. Department of Education’s Office for Civil Rights recently issued a FAQ in its continuing effort to address civil rights issues during the COVID-19 pandemic.  The new guidance focused on disability accommodations, Title IX, and harassment issues.

Performance Under Cannabis Contracts During a Pandemic

The COVID-19 pandemic has wreaked havoc on nearly every industry in the global economy. The nascent and volatile cannabis industry was not exempt and, in some jurisdictions, has been impacted significantly due to local or state shelter or stay-at home orders. In most states where adult-use cannabis is legal, local and state governments have deemed cannabis businesses as essential and, thus, are permitted to continue operating notwithstanding local or state shelter orders. However, despite their characterization as essential businesses, many limitations imposed by local or state shelter orders have greatly affected the way cannabis businesses operate. As a result, cannabis businesses have experienced steep declines in their revenues and, in some instances, have left cannabis businesses unable to perform contractual obligations that they entered into pre-pandemic.

Congressional Efforts to Compel Coronavirus Business Interruption Insurance

We previously wrote about the growing number of lawsuits by insureds seeking business interruption insurance coverage for business losses in response to the novel coronavirus (here and here), and the constraints that state and federal governments should face were they to compel such coverage. We also previously detailed nationwide efforts aimed at enacting legislation compelling business interruption and contingent business interruption insurance for COVID-19 losses. As of the date of this update, eight states have proposed a number of bills relating to business interruption insurance, and Congress has also waded in.

New Jersey Announces Plan for the Restart of Non-Essential Construction and the Curbside Reopening of Non-Essential Retail Stores

New York Forward Plan Reopens Construction in Phase One

On May 15, 2020, Governor Andrew Cuomo’s Executive Orders 202.6 and 202.8, which stopped all nonessential work in New York, will expire. New York will then shift to “New York Forward,” the state’s plan to reopen nonessential businesses and return people to work, without triggering renewed spread of COVID-19 or overwhelming the healthcare system.
