On May 13, New Jersey Governor Murphy announced the permissible reopening of nonessential retail stores for curbside pick up, and drive thru attractions, as well as the authorization for nonessential construction to resume.

New Jersey Governor Phil Murphy issued Executive Order 138 (“EO 138”), which extends the Public Health Emergency declared on March 9, 2020 under Executive Order 103 for another 30 days until June 5, 2020.

Late last week (April 24, 2020), NJ Gov. Murphy signed Executive Order No. 128 (“EO”). The EO takes effect immediately and will remain in effect until the end of the public health emergency established by Executive Order No. 103 (2020). The EO applies in the context of residential leases (not commercial leases) and allows residential tenants to use their security deposit for the payment of rent.

New Jersey has officially announced the 21 members of its COVID Taskforce. The group will include 16 members and 5 ex-officio members from the Murphy administration. It will be co-chaired by Merck Chair and CEO Ken Frazier and former Princeton President Shirley Tilghman.

Gov. Murphy announces New Jersey’s 6-point reopening plan called “The Road Back: Restoring Economic Health Through Public Health.” The governor also reiterated that his “Stay-at-Home” executive order will remain in effect until further notice.” The plan also calls for a measurable drop in cases over a 14-day period before a reopening happens.

Governor Phil Murphy signed into law Senate Bill 2304 (S2304), expanding leave rights and benefits available to workers under New Jersey’s Earned Sick Leave Law, Family Leave Act, Temporary Disability Benefits Law and Family Leave Insurance Program for absences attributed to COVID-19. This law took effect immediately as of March 25, 2020.

Governors Cuomo and Murphy announced additional measures intended to protect workers and citizens in New York and New Jersey.
On April 12, 2020, New York Governor Andrew Cuomo issued Executive Order 202.16, which will require employees of essential businesses who are present in the workplace to wear face coverings when in direct contact with customers or members of the public. This order goes into effect April 15, 2020, at 8:00 p.m.
On April 8, 2020, New Jersey Governor Phil Murphy issued Executive Order 122, which created new restrictions and requirements applicable to certain employers across the state, specifically those involved in warehousing, manufacturing, essential retail businesses and construction. In addition to closing all nonessential construction, the order mandates various new requirements employers must implement such as policies for employees to wear cloth face coverings and gloves. Executive Order 122 went into effect on April 10 at 8:00 p.m.
